Accessibility Improvement Act (BFSG) Checklist
The internationally recognized Web Content Accessibility Guidelines (WCAG) serve as the basis for the Accessibility Improvement Act (BFSG) and other accessibility acts. These guidelines define appropriate measures and technical specifications for the implementation of digital accessibility.

Who is affected by the BFSG?
The Accessibility Enhancement Act (BFSG) refers to offers for consumers, i.e., B2C. Before companies deal with the requirements of the BFSG, they should check, whether the Accessibility Act applies at all. According to the law implementing Directive (EU) 2019/882, this includes e-commerce services, online shops, self service terminals, telecommunications services, digital products, e-books and e-book readers, as well as certain hardware.
Providing accessible services
General accessibility requirements apply to digital services (websites or apps). Section 12 of the Accessibility Enhancement Act (BFSGV) stipulates that general description, websites, user interfaces, payment terminals, check in machines, and support services such as help desks or call centers must be accessible. These services must offer accessible communication tools such as modern CAPTCHAs and be operable with assistive technologies. Specifically, the entire website or app must be accessible, not just individual areas for concluding contracts.
Information on digital accessibility is mandatory
Service providers and companies must publicly provide a general description of digital accessibility of their services and products in accordance with Annex 3 BFSG. It clarifies what is offered, which accessibility requirements are met, and which market surveillance authority is responsible.
Additional obligations for online shops
Operators of e-commerce services and online shops must also display information on the accessibility of the products and services offered in accordance with § 19. Identification, authentication, security, and payment functions must be designed to be accessible, and electronic signatures must be supported in an accessible manner.
Functional performance criteria
Services and products must be fundamentally accessible in accordance with the Accessibility Strengthening Act BFSG § 21. This means that users without specific sensory and motor requirements must be able to access them. Traditional CAPTCHAs such as reCAPTCHA or hCaptcha still use visual puzzles such as selecting images with traffic lights as a fallback for critical evaluations. This means that these traditional CAPTCHA services are not BFSG-compliant.
